Conditions of Use
§1 Conclusion of Contract
(1) The buyer's order consitutes an offer to buy an item. When we receive an order we send the buyer an email, that informs him that we have received an order and details the particulars of this order. When the vender sends this order confirmation this does not mean that the contract has been accepted by the vender. The conclusion of the contract comes about only when the ordered item has actually been sent out and the delivery statement has been emailed to the buyer.
(2) The vender may send a replacement of equal value and quality if the ordered item is not in stock, and if the buyer has given his consent. The vender is not required to make delivery of an item that is not in stock. If an ordered item is not in stock the vender will inform the buyer and return payment as soon as possible.
§ 2 Expenses
The buyer pays for the costs of a return delivery in the following cases:
- if the order was correctly sent by the vender and the value of the returned item is below 40 Euros
- if the buyer had not yet made payment or partial payment at the time he returned the item
Otherwise the return delivery is free of charge for the buyer.
§ 3 Ordering Process and Making Changes before Finalising the Order
(1) The buyer may select and order items on oure website.
(2) Each item for sale has a product description on the website.
(3) The buyer may click on each item for sale. The items chosen are collected in a virtual shopping cart. At the end of the selection process the buyer is shown an itemised list and the total price including value added tax.
(4) Before finalising his order, the vender allows the buyer to check his order for price and amount and to make changes if necessary.
§ 4 Implementation of Contract
Order Processing
After the buyer has completed the online order he receives an automated summary of his order at the email address he specified. Since the legal transaction only comes about at the time of delivery, a written copy of the contract is not stored by the vender at this time.
Payment Methods
The buyer may pay cash-on-delivery (only in Germany), PayPal or by advance bank transfer. Should the buyer choose bank transfer, he will receive an email with the neccessary bank information.
Delivery
If ordered items are in stock the vender will make delivery as soon as possible, or latest 3-4 business days after order date. If the buyer is not a consumer, delivery is made at the buyer’s risk and expense. A consumer is a natural person who makes a legal transaction that does not serve his self-employed, professional or commercial activities.
§ 5 Prices
(1) The prices listed on the website at the time of order will apply.
(2) The prices include value added tax but exclude packaging and shipment fees.
